A happy farewell for spam but what do I need to do to comply with Protection of Personal Information Act (POPIA)?
If you are anything like me, you have never been happier to receive unsolicited mail of the kind that is now asking you to unsubscribe once and for all. But in the back of your mind, you are seeing all of these mails and thinking, this POPIA stuff is real I had better start dealing with it…. but how?
It appears that for lay people that operates small to medium size businesses, they are forced to engage with consultants and lawyers to get their businesses compliant. In the midst of the Delta variant of Covid-19 and the multitude of challenges that business owners face, having to spend substantial amounts of time and money on POPIA compliance is to say the least annoying. Many of you will put it differently and say “it aint going to happen!”. Fortunately, there is a cost effective solution at hand. Contractzone offers a large range of online legal contracts and the team of experienced lawyers has put together a comprehensive online POPIA solution that gives you the tools to get compliant without employing outside consultants.
How does it work. Well, you register for free and select the Consolidated Pack of Compliance Documents in terms of POPIA. The system takes you through a series of questions that evaluates your POPIA compliance, while at the same time generating the critical POPIA documents that you need. To guide you through the process, the pack of documents includes a POPIA checklist and a Personal Information Impact Assessment.
In addition, the following documents are generated to assist you in complying with POPIA:
Manual in terms of the Promotion to Information Act, 2000;
Compliance Framework and Manual in terms of the Protection of Personal Information Act, 2013
A consent form for Employees to sign (this is important as employers will always be processing the Personal Information of their staff);
A consent form for Customers to sign. Again, this is important as your customers will often insert personal information in a credit application and you may obtain credit related information from a credit bureaux. We recommend that for all new accounts this form is an addendum to your credit application form;
Supplier Consent form;
Privacy Policy;
Formal appointment letter for your Information Officer;
Internal Awareness Training Material. The training material gives your Information Officer the tools to make staff aware of the requirements of POPIA. Included in the training material is an attendance register which should be kept on file to demonstrate that you have conducted these training sessions.
Importantly, the POPIA compliance pack comes in at a fraction of the cost that you would pay external consultants. The all inclusive cost is R4,350, including VAT. Alternatively, if you want to access the full range of POPIA documents (20 in total) you can purchase a POPIA subscription, which gives you unlimited access to the documents for a 12 month period. All documents are received in PDF and Word format.
